Organising a fundraising event in New South Wales (NSW) that includes the sale or service of alcohol requires adherence to specific regulations to ensure compliance and the safety of all attendees. Here's a concise guide to help you navigate the necessary steps:
Sale of Alcohol: If your event involves selling alcohol—either directly or as part of an entry fee—a liquor licence is generally mandatory - see the Exemption below for not-for-profit organisations.
Supply Without Sale: Even if alcohol is provided free of charge, a licence may still be required, especially if the event is publicly advertised or held in a public space.
Not-for-profit organisations may be eligible to sell alcohol at up to six fundraising functions annually without obtaining a liquor licence. This exemption is subject to specific conditions:
Eligibility: The organisation must be a non-proprietary association, local council, or a community organisation associated with a school.
Conditions: The sale of alcohol is limited to a maximum of four hours between 6 am and midnight on the day of the function. All proceeds must support the organisation's objectives, and alcohol must be consumed at the function—it cannot be taken away.
Notification: A 'Notice of Function' form must be submitted to Liquor & Gaming NSW at least 14 days before each function.
If your organisation plans to conduct more than six events annually or does not meet the exemption criteria, applying for a limited licence is necessary:
Single Function Licence: Allows the sale of alcohol at a one-off event.
Multiple Functions Licence: Permits the sale of alcohol at up to 52 events per year.
Applications for limited licences should be submitted at least 28 days before the first event.
Responsible Service of Alcohol (RSA): Ensure all staff and volunteers involved in serving alcohol hold current RSA certification.
Minors: Implement strict measures to prevent the sale or supply of alcohol to individuals under 18 years of age.
Supervision: The licensee or a nominated responsible person must be present during the sale of alcohol at the function.
Trading Hours: Adhere to the trading hours specified in the licence or exemption conditions.
