Raffle Rules in Tasmania (Effective 4 September 2024)

Raffles are a fantastic way to raise funds for charitable and community causes, but they must adhere to the rules set out under Tasmania’s Gaming Control Act 1993. The recent changes to minor gaming rules simplify the process and increase flexibility for organisers while maintaining accountability. Here’s what you need to know.


Key Changes to Raffle Rules (Effective 4 September 2024)

  1. Permit Requirement Threshold:
    • A minor gaming permit is now required only when the total prize value exceeds $10,000 (previously $5,000).
    • Raffles with total prize values of $10,000 or less are exempt games and do not require a permit, provided conditions are met.
  2. Permit Duration:
    • Permits for raffles can be issued for up to 12 months.
    • Existing permit holders will continue under their current permits until they expire.
  3. Record-Keeping:
    • Permit holders must keep detailed records using the “Authorised Raffles - Record Keeping Form” for 7 years.
    • The Commission may request these records at any time or require submission within a specified timeframe.

Rules for Exempt Raffles (Prize Value ≤ $10,000)

Raffles under $10,000 are exempt from requiring a permit but must comply with the following conditions:

  • Proceeds:
    • A minimum of 20% of gross ticket sales must go toward the benefiting organisation or charitable purpose.
    • Only reasonable costs for prizes and operations can be deducted.
  • Cash Prizes: Allowed, but total cash or cash-equivalent prizes cannot exceed $5,000.
  • Participant Eligibility:
    • Tickets cannot be sold to individuals under 18 years.
    • Sellers under 13 years old are prohibited, and sellers aged 13–15 are restricted to raffles where the total prize value is $500 or less.
  • Ticket Pricing:
    • All tickets must be sold for the same price.
    • Bundling (e.g., 3 tickets for $5) is permitted only when the prize value is less than $1,000.
  • Drawing:
    • Must be conducted fairly, allowing every ticket an equal and random chance of being drawn.
    • Reverse raffles (where the first ticket drawn wins the least valuable prize) are prohibited.

Rules for Authorised Raffles (Prize Value > $10,000)

Raffles exceeding $10,000 require a minor gaming permit and must comply with the following:

  1. Proceeds:
    • Must be used solely for the specified charitable purpose or not-for-profit organisation.
    • Distribution of proceeds must occur within 6 weeks of the draw.
  2. Ticket Requirements:
    • Tickets must display:
      • Name, address, and permit number of the organiser.
      • Description and retail value of prizes.
      • Price and total number of tickets available.
      • Draw date, location, and results publication method.
    • Participant contact details must be recorded to ensure winners can be reached.
  3. Prohibited Prizes:
    • Tobacco, firearms, ammunition, cosmetic surgery, and dangerous articles are banned.
  4. Record Keeping:
    • Maintain detailed records, including ticket sales, expenses, prize distribution, and participant information, for 7 years.
  5. Draw Rules:
    • The first ticket drawn must win the most valuable prize.
    • Winners must be notified promptly and within 2 weeks of the draw.
    • If prizes remain unclaimed after 9 months, they must be sold or otherwise disposed of, with proceeds distributed to the intended charity.

Applying for a Minor Gaming Permit

For raffles exceeding $10,000, apply for a permit through the Tasmanian Liquor and Gaming Commission. Key details:

  • Each raffle requires a separate permit.
  • Permits are valid for up to 12 months.
  • Fees and forms are available on the Treasury Tasmania website.

Additional Rules for All Raffles

  • Transparency: Information about the raffle must be clear and accessible, including ticket prices, prize details, and beneficiary organisations.
  • No Abandonment: Raffles cannot be cancelled due to low ticket sales.
  • Equal Access: Participants must not be required to attend the draw to win.
